Terms of Service & Acceptable Use Policy

Last Updated: October 2026

1. About Us and These Terms

1.1. Bare Metal Gaming ([www.baremetalgaming.com](https://www.baremetalgaming.com)) is a trading name of The WiFi and Network People Ltd, a company registered in England and Wales under company number 17115691, with its registered office at 27 Pointers Close, London, E14 3AP, United Kingdom ("we", "us", "our").

1.2. These Terms of Service ("Terms") govern your purchase and use of our virtual private server (vPC) game hosting services ("Services"). By placing an order or using our Services, you agree to be bound by these Terms.

2. Scope of Service & Panel-Only Access

2.1. Platform as a Service (PaaS): We provide managed Linux-based virtual private server environments configured specifically for hosting multiplayer game servers.

2.2. Panel-Only Access: Your subscription grants you administrative access exclusively to the CubeCoders AMP (Application Management Panel) web interface deployed on your server. You do not receive root access, SSH access, or underlying operating system access. Any attempt to bypass the AMP interface to gain unauthorized operating system or host-level access is a material breach of these Terms.

2.3. Instance Limits and Add-Ons: By default, your vPC subscription includes an allocation of up to three (3) concurrent game server instances within your AMP environment. You may purchase additional instance slots for €1.00 (EUR) per instance per billing cycle, subject to your vPC hardware capacity.

3. Manual Provisioning & Delivery

3.1. Provisioning Window: To ensure optimal configuration and security, all servers are provisioned manually by our engineering team. Servers are not deployed instantly upon checkout.

3.2. Delivery Timeframes: Standard provisioning takes place within 24 to 48 hours of confirmed payment (excluding weekends and UK public holidays, unless otherwise stated). Your billing cycle and minimum contract term begin on the date your AMP login credentials are dispatched to your registered email address.

4. 14-Day Cooling-Off Period & Statutory Waiver (UK & EU Consumers)

4.1. Under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive (2011/83/EU), consumers generally have a 14-day right to cancel a distance contract ("cooling-off period").

4.2. Waiver Upon Provisioning: Because our Services involve the custom, manual provisioning of dedicated virtual server resources, you explicitly request and consent at checkout for us to begin provisioning your server before the 14-day cooling-off period expires. You acknowledge that once manual provisioning of your vPC has commenced, you lose your statutory 14-day right to cancel and receive a refund.

4.3. If you request to cancel your order after payment but before our team has begun provisioning your server, we will cancel the order and issue a full refund.

5. Minimum Contract Term (90-Day Tie-In Period)

5.1. 90-Day Minimum Commitment: All vPC subscriptions are subject to a mandatory 90-day minimum contract term ("tie-in period") starting from the date your server is provisioned.

5.2. Payment Obligation: Whether billed monthly or quarterly in advance, you are contractually committed to paying for the full 90-day tie-in period. Stopping payments or cancelling a recurring payment method via your bank or payment processor during the initial 90 days does not release you from your debt obligation for the remainder of the 90-day period.

5.3. Renewal After 90 Days: Following the initial 90-day tie-in period, your subscription will automatically continue on a rolling 30-day (monthly) basis unless cancelled in accordance with Section 7.

6. Billing, Payments, and Late Fees

6.1. Advance Billing: All Services are billed in advance of the service period.

6.2. Overdue Invoices & Suspension: If a renewal payment fails or an invoice remains unpaid 48 hours past its due date, we reserve the right to temporarily suspend access to your AMP instance and stop running game servers.

6.3. Data Deletion for Non-Payment: If an account remains unpaid 7 days after the due date, we reserve the right to permanently terminate the server and wipe all associated game data, world saves, and configurations without further liability.

7. Cancellation by You

7.1. Notice Period: You may cancel your subscription to take effect at the end of your initial 90-day tie-in period (or at the end of any subsequent monthly billing cycle) by providing at least 7 days' notice prior to your next renewal date via our support channels or billing portal.

7.2. No Mid-Cycle Refunds: If you choose to stop using your server partway through a paid billing cycle, no partial or pro-rata refunds will be issued for unused time. Your server will remain accessible until the end of the paid period.

8. Suspension & Termination by Us

8.1. Immediate Termination for Cause (No Refund): Bare Metal Gaming (trading under The WiFi and Network People Ltd) reserves the right to suspend or terminate your Services immediately, without prior notice and without refund, if:

  • You breach any provision of our Acceptable Use Policy (Section 9);

  • You fail to pay due invoices within the timeframes set out in Section 6;

  • Your server is the target or source of sustained network attacks (e.g., DDoS) that threaten the stability of our broader infrastructure or third-party EU data centers; or

  • We are required to do so by law, court order, or our upstream data center providers.

8.2. Termination for Convenience (No Fault): We reserve the right to terminate your contract at our discretion without cause (for example, if we discontinue a specific hardware tier or cease offering a service) by providing you with at least 14 days' written notice so that you may download your game saves and backups. If we terminate your contract under this clause without fault on your part, we will issue a full pro-rata refund for any prepaid, unused days remaining in your current billing period.

9. Acceptable Use Policy (AUP)

Your vPC resources are dedicated to running legitimate multiplayer gaming instances via AMP. You must not use, or allow players on your servers to use, our Services for any of the following prohibited activities:

9.1. Resource & Hardware Abuse:

  • Cryptocurrency mining, blockchain node operation, or folding@home workloads.

  • Running unauthorized background scripts, web scrapers, proxy/VPN exit nodes, or non-gaming workloads by disguising them as game instances.

9.2. Network Abuse:

  • Launching or participating in Denial of Service (DoS/DDoS) attacks, port scanning, packet spoofing, or network flooding.

  • Hosting malicious files, malware, botnet command-and-control servers, or phishing content.

9.3. Illegal & Infringing Content:

  • Uploading, hosting, or distributing pirated software, cracked game server binaries, or intellectual property for which you do not hold the required usage rights.

  • Hosting or transmitting any material that is unlawful under UK or EU law, including CSAM, terrorism-related content, or defamation.

  • Violating the End User License Agreements (EULAs) or Terms of Service of the respective game publishers (e.g., Valve, Mojang/Microsoft, Keen Software House, etc.).

10. Division of Responsibility: The Platform vs. Deployed Software

To ensure clarity under the UK Consumer Rights Act 2015 and the EU Digital Content and Digital Services Directive (2019/770), responsibilities between Bare Metal Gaming and the Customer are strictly divided as follows:

10.1. Our Statutory Responsibility (The Platform): Bare Metal Gaming is responsible exclusively for providing the underlying virtual private server (vPC) hardware allocation, network connectivity, and a functional, licensed installation of the base CubeCoders AMP web management interface. Our obligation is limited to ensuring the hosting environment and the AMP control panel itself remain operational in accordance with these Terms.

10.2. Your Responsibility (Deployed Software): Once you log into your AMP control panel and deploy, download, or install any game server binaries, applications, files, or configurations (whether via SteamCMD, official game repositories, CurseForge, or manual uploads), Bare Metal Gaming acts strictly as a neutral Platform as a Service (PaaS) host. We do not own, develop, control, warrant, or endorse any third-party software deployed within your AMP instances.

10.3. Third-Party Licenses, Accounts & Fees: You are solely responsible for ensuring that you hold the necessary legal rights and licenses to install and run any software deployed inside your AMP environment. If any game server, modpack, plugin, or service requires a purchased game copy, Steam account authentication, commercial server license key (e.g., Patreon/Cfx.re keys), API token, or any other third-party fee, it is exclusively your responsibility to acquire those rights and pay all associated fees directly to the respective third-party publisher or vendor.

10.4. No Warranty on Third-Party Game Servers & Mods: All game servers, game updates, modpacks, and plugins deployed via AMP are provided "as-is" by their respective third-party developers. We are not responsible or liable for software bugs, broken game updates, memory leaks, CPU/RAM spikes, mod incompatibilities, or server crashes caused by the third-party software you choose to run.

10.5. Backups: While your AMP panel provides tools to generate local archives of your game worlds, you are solely responsible for downloading and maintaining off-server backups of your world saves and configuration data. We are not liable for corrupted world saves caused by game updates, mod conflicts, or hardware failures.

10.6. Player Data: If your game server logs player IP addresses, chat logs, or identifiers (such as SteamIDs or UUIDs), you act as the independent Controller of that data and are responsible for managing your community fairly and lawfully.

11. Service Availability & Maintenance

11.1. We aim to maintain high availability across our EU data center infrastructure. However, we do not guarantee 100% uninterrupted uptime.

11.2. Scheduled & Emergency Maintenance: Occasionally, we or our upstream data center partners must perform hardware maintenance, hypervisor updates, or security patching on the underlying Linux environment or AMP installation. Where possible, we will provide advance notice of scheduled maintenance.

12. Limitation of Liability

12.1. Statutory Rights: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other consumer rights that cannot be excluded under UK or EU law (including the UK Consumer Rights Act 2015).

12.2. Exclusion of Indirect Losses: Subject to clause 12.1, The WiFi and Network People Ltd shall not be liable for any indirect, consequential, or special losses, including loss of data (such as game world saves), loss of community revenue/donations, or loss of goodwill.

12.3. Liability Cap: To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Services shall be limited to the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

13.2. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales. If you are a consumer residing in the European Union or another part of the United Kingdom (Scotland or Northern Ireland), you also benefit from any mandatory consumer protection provisions of the law of your country of residence, and you may bring legal proceedings in the courts of the country in which you reside.
